Terms of Service

Welcome to ServedByAI ("Platform", "we", "us", or "our"). ServedByAI is an online marketplace that connects buyers seeking AI-powered services with providers offering those services. By accessing or using our Platform, you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully before using the Platform. If you do not agree with any part of these Terms, you may not use the Platform.

"Buyer" refers to any user who registers on the Platform to browse, purchase, or request AI services.

"Provider" refers to any user who registers on the Platform to offer, deliver, or sell AI services.

"Service" refers to any AI-related service listed on the Platform by a Provider.

"Task" refers to a project request posted by a Buyer seeking proposals from Providers.

"Proposal" refers to a Provider's offer to complete a Task or fulfill a Service request, including pricing and delivery terms.

"Order" refers to a confirmed agreement between a Buyer and a Provider after a Proposal has been accepted.

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorized access to your account.

You must be at least 18 years old to create an account and use the Platform.

ServedByAI facilitates connections between Buyers and Providers. We are not a party to any agreement between Buyers and Providers. We do not guarantee the quality, safety, or legality of services offered, the accuracy of listings, or the ability of Providers to deliver services.

Buyers can browse services, post tasks, and request proposals. Providers can list services, browse tasks, and submit proposals. When a Buyer accepts a Proposal, an Order is created.

All pricing is proposal-based. Providers set their own prices, and Buyers agree to the price before payment is made.

Payments are processed through Stripe, our third-party payment processor. By using the Platform, you agree to Stripe's terms of service and privacy policy.

ServedByAI charges a commission of 15% from the Provider on each completed transaction. Founding Providers may receive a reduced commission rate of 10% for their first six months.

Buyers are not charged any additional fees by ServedByAI beyond the agreed price with the Provider.

Payments are held in escrow until the Buyer accepts the delivered work. If the Buyer does not respond within 3 business days after delivery, the order is automatically marked as complete and payment is released to the Provider.

If a Buyer is not satisfied with the delivered work, they may request revisions as agreed in the Proposal, or open a dispute.

Disputes are reviewed by our team. We reserve the right to issue full or partial refunds at our discretion based on the evidence provided by both parties.

Refund requests must be submitted within 7 days of delivery. After an order is marked as complete, refunds are no longer available through the Platform.

Providers must deliver work that matches the scope agreed upon in the accepted Proposal. Providers are responsible for the quality and accuracy of their work.

Providers must communicate professionally and respond to messages within a reasonable timeframe.

Providers must not share personal contact information (email, phone, social media) through the Platform's messaging system to circumvent payment through ServedByAI.

Providers are independent contractors, not employees of ServedByAI. Providers are responsible for their own taxes, insurance, and compliance with applicable laws.

Buyers must provide clear and complete requirements when posting tasks or requesting services. Buyers must respond to deliveries within a reasonable timeframe.

Buyers must pay for accepted work as agreed in the Proposal. Buyers must not request work outside the agreed scope without a revised Proposal.

You may not use the Platform to engage in any illegal, fraudulent, or harmful activity. This includes but is not limited to:

Sharing personal contact information to conduct transactions outside the Platform. Posting misleading or false content. Harassing, threatening, or abusing other users. Attempting to manipulate reviews or ratings. Creating multiple accounts to circumvent Platform rules. Using automated tools to scrape, access, or interact with the Platform without permission.

Upon completion of an Order and full payment, ownership of the delivered work transfers from the Provider to the Buyer, unless otherwise agreed in writing within the Proposal.

Providers retain the right to showcase completed work in their portfolio unless the Buyer explicitly requests otherwise.

ServedByAI retains all rights to the Platform's design, code, branding, and content. Users may not copy, reproduce, or create derivative works from any Platform content.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. Please review our Privacy Policy for more information.

ServedByAI provides the Platform "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted access, error-free operation, or that the Platform will meet your specific requirements.

To the maximum extent permitted by law, ServedByAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim arising from or related to the Platform shall not exceed the fees paid by you to ServedByAI in the 12 months preceding the claim.

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion.

You may close your account at any time by contacting us. Upon termination, any pending orders must be completed or resolved before your account is fully closed.

We may update these Terms from time to time. When we make material changes, we will notify registered users by email and update the "Last updated" date at the top of this page.

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be resolved in the courts of Eindhoven, the Netherlands.
